San Diego DUI Restricted Drivers License

When you have been convicted of DUI in San Diego your license will be suspended for the mandatory 6 month suspension if it is your first offense. However, because it is your first offense you immediately qualify to apply for a restricted drivers license which will allow you to drive to and from work at certain times and to and from DUI school.

If it is your second offense then your license will be suspended for 2 years and you must wait 1 year before you can apply for a restricted drivers license. On your third offense your license will be suspended for 3 years and you must wait 18 months before qualifying to apply.

To apply for a restricted drivers license in San Diego you must do the following 3 things:

  1. Be enrolled in the court approved DUI school as instructed by the court
  2. Provide SR-22 form to DMV as proof of car insurance
  3. Pay a $125 reinstatement fee

What is an SR-22 form? An SR-22 is a form that proves to the DMV that you have car insurance. If at any time during the period of your probation you allow your car insurance policy to lapse or be cancelled then under the terms of the SR-22 your insurance company has to immediately inform the DMV and your license will be suspended. Your car insurance company will file the SR-22 form electronically with the DMV on your behalf.
